Terms of use

These terms cover the Charly app for Mac, the Charly apps for iPhone and Apple Watch, and getcharly.dev. Charly is made by Carlos Silva, an independent developer in Colombia. Questions: hola@getcharly.dev.

1. The license

You may install and use Charly on your own Macs for your own work, personal or commercial. You may not resell, rent or redistribute it, or remove its license checks. Charly stays the property of its author; you get a license to use it, not ownership of the software.

2. Plans

• Free: unlimited agents in one local project at a time.
• Charly Pro: a subscription, monthly or yearly, that adds unlimited and remote (SSH) projects, the iPhone and Apple Watch apps and ongoing updates. New users get a 30-day free trial once per Mac.
• Lifetime and Founder: one-time licenses for Charly Pro, offered from time to time.

One license can be active on a limited number of Macs at once; you can free a Mac from Settings → Charly Pro and use the license on another.

3. Payments

Purchases are processed by Creem, which acts as the merchant of record: Creem sells the license, charges your payment method and handles sales tax, VAT and invoices. Its terms apply to the payment. Prices are in US dollars; taxes are added at checkout where they apply.

4. Renewals and cancellation

Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time from the customer portal linked in your purchase email; Pro stays on until the end of the period you paid for. If you cancel a yearly plan, you keep Charly Pro on the versions of Charly released while your subscription was active; newer versions go back to the Free plan until you renew. We may change prices for future periods and will tell you by email before a renewal at a new price.

6. Coding agents and your code

Charly runs coding agents made by others (such as Claude Code and OpenCode) on your machines. You need your own accounts with them, and their terms apply to their use. Agents can read, change and delete files and run commands; you decide what they do and in which mode (including automatic mode, which lets them act without asking). Charly saves restore points to help you undo changes, but you are responsible for your code, your data and your backups.

7. Acceptable use

Don’t use Charly to break the law, to attack systems you don’t own or aren’t authorized to test, or to get around its license checks.

8. No warranty

Charly is provided “as is”. We work to keep it reliable and up to date with new versions of the agents and of Apple’s systems, but we can’t guarantee it will be free of errors or always available, or that third-party agents and services will keep working with it.

9. Liability

To the extent the law allows, our total liability for any claim related to Charly is limited to the amount you paid for it in the 12 months before the claim. We are not liable for lost data, lost profits or indirect damages, including changes made by coding agents.

10. Changes and law

We may update these terms; the date above shows the latest version, and we’ll tell paying customers by email about important changes. These terms are governed by the laws of Colombia, without prejudice to the consumer rights of the country where you live.

Estos términos cubren la app Charly para Mac, las apps de Charly para iPhone y Apple Watch, y getcharly.dev. Charly lo hace Carlos Silva, desarrollador independiente en Colombia. Dudas: hola@getcharly.dev.

1. La licencia

Puedes instalar y usar Charly en tus propios Mac para tu propio trabajo, personal o comercial. No puedes revenderlo, alquilarlo ni redistribuirlo, ni quitar sus comprobaciones de licencia. Charly sigue siendo propiedad de su autor; recibes una licencia de uso, no la propiedad del software.

2. Planes

• Gratis: agentes ilimitados en un proyecto local a la vez.
• Charly Pro: una suscripción, mensual o anual, que añade proyectos ilimitados y remotos (SSH), las apps de iPhone y Apple Watch y actualizaciones continuas. Los usuarios nuevos tienen 30 días de prueba gratis, una vez por Mac.
• De por vida y Fundador: licencias de pago único de Charly Pro, que se ofrecen de vez en cuando.

Una licencia puede estar activa en un número limitado de Mac a la vez; puedes liberar un Mac desde Ajustes → Charly Pro y usar la licencia en otro.

3. Pagos

Las compras las procesa Creem, que actúa como revendedor oficial (merchant of record): vende la licencia, cobra tu medio de pago y gestiona el IVA, los impuestos y las facturas. Al pago se aplican sus condiciones. Los precios están en dólares (USD); los impuestos se añaden al pagar cuando corresponde.

4. Renovaciones y cancelación

Las suscripciones se renuevan automáticamente al final de cada periodo hasta que las canceles. Puedes cancelar cuando quieras desde el portal de cliente enlazado en tu email de compra; Pro sigue activo hasta el final del periodo pagado. Si cancelas un plan anual, conservas Charly Pro en las versiones de Charly publicadas mientras tu suscripción estuvo activa; las versiones más nuevas vuelven al plan gratis hasta que renueves. Podemos cambiar los precios de periodos futuros y te avisaremos por email antes de una renovación a un precio nuevo.

6. Agentes de código y tu código

Charly ejecuta en tus máquinas agentes de código hechos por otros (como Claude Code y OpenCode). Necesitas tus propias cuentas con ellos, y su uso se rige por sus condiciones. Los agentes pueden leer, cambiar y borrar archivos y ejecutar comandos; tú decides qué hacen y en qué modo (incluido el modo automático, que les deja actuar sin preguntar). Charly guarda puntos de restauración para ayudarte a deshacer cambios, pero tú eres responsable de tu código, tus datos y tus copias de seguridad.

7. Uso aceptable

No uses Charly para infringir la ley, para atacar sistemas que no son tuyos o que no tienes permiso para probar, ni para saltarte sus comprobaciones de licencia.

8. Sin garantía

Charly se ofrece «tal cual». Trabajamos para que sea fiable y esté al día con las versiones nuevas de los agentes y de los sistemas de Apple, pero no podemos garantizar que no tenga errores, que esté siempre disponible ni que los agentes y servicios de terceros sigan funcionando con él.

9. Responsabilidad

En la medida en que la ley lo permita, nuestra responsabilidad total por cualquier reclamación relacionada con Charly se limita a lo que pagaste por él en los 12 meses anteriores. No respondemos de datos perdidos, beneficios perdidos ni daños indirectos, incluidos los cambios hechos por agentes de código.

10. Cambios y ley aplicable

Podemos actualizar estos términos; la fecha de arriba indica la versión vigente, y avisaremos por email a los clientes de pago de los cambios importantes. Estos términos se rigen por las leyes de Colombia, sin perjuicio de los derechos de consumidor del país donde vivas.
